General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor part of their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

With regard to entrepreneurs, these GTC shall also apply to future business relationships without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contracting Parties, Formation of Contract

The purchase contract is concluded with electronic-studio, Mario Hinkelmann.

The presentation of the products in the online shop does not constitute a legally binding offer, but rather an unbinding online catalogue. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The receipt of your order will be confirmed by email immediately after the order has been sent.

The time at which the contract with us is concluded depends on the payment method you have chosen:

  • Payment in advance (Vorkasse): We accept your order by sending a declaration of acceptance in a separate email within two days, in which we provide you with our bank details.
  • PayPal: During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.
  • Cash payment upon collection: We accept your order by sending a declaration of acceptance in a separate email within two days.

3. Contract Language, Storage of Contract Text

The languages available for the conclusion of the contract are German and English.

We store the text of the contract and send you the order data and our GTC via email. You can view the text of the contract in our customer login area.

4. Delivery Conditions

Shipping costs are added to the stated product prices. Further details regarding the shipping costs can be found within the offers.

In principle, you have the option of collecting the goods from electronic-studio, Gustaf-de-Laval-Str. 11, 29683 Bad Fallingbostel, Germany, during the business hours specified below: Tue, Thu,

Fri 10:00h - 13:00h and 16:00h - 19:00h

We do not deliver to packing stations (Packstationen).

5. Payment

The following payment methods are generally available in our shop:

  • Payment in advance (Vorkasse): If you select the payment method advance payment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.
  • PayPal: During the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. You will receive further information during the ordering process.
  • Cash payment upon collection: You pay the invoice amount in cash when collecting the goods.

6. Retention of Title

The goods remain our property until full payment has been made.

For entrepreneurs, the following applies additionally: We retain title to the goods until full settlement of all claims arising from an ongoing business relationship. You may resell the reserved goods in the ordinary course of business; you assign all claims arising from this resale to us in advance—irrespective of any combination or mixing of the reserved goods with a new item—in the amount of the invoice total, and we accept this assignment. You remain authorized to collect the claims, but we may also collect the claims ourselves if you fail to meet your payment obligations.

7. Transport Damage

For consumers, the following applies:
If goods are delivered with obvious transport damage, please complain about such defects to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance.

For entrepreneurs, the following applies:
The risk of accidental destruction and accidental deterioration shall pass to you as soon as we have delivered the item to the forwarder, the carrier, or the person or institution otherwise designated to carry out the shipment. Among merchants, the obligation to inspect and give notice of defects as regulated in Section 377 of the German Commercial Code (HGB) applies. If you fail to give the notice regulated therein, the goods shall be deemed approved, unless the defect was not recognizable during the inspection. This shall not apply if we have fraudulently concealed a defect.

8. Warranty and Guarantees

The statutory liability rights for defects apply. Information on any applicable additional guarantees and their exact conditions can be found with the respective product and on special information pages in the online shop.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/.

We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board. The competent body is the Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de.

10. Final Provisions

If you are an entrepreneur, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
